These Terms & Services ("Terms") govern your access to the website compliancepsa.com (the "Site") operated by Compliance PSA Home Warranty ("Compliance PSA," "we," "us," or "our") and your enrollment in any home warranty or residential service plan (collectively, "Plan") offered by us. By using the Site, submitting a request for coverage, or enrolling in a Plan, you agree to these Terms. If you do not agree, do not use the Site or enroll in a Plan.
1. Nature of Home Warranty Service
A home warranty is a service contract that provides repair or replacement of covered systems and appliances in your primary residence when they fail due to normal wear and tear, subject to the limitations in your Plan documents. A home warranty is not homeowner's insurance, does not cover structural components or casualty events, and does not replace manufacturer warranties unless expressly stated.
Your specific coverage, dollar limits, waiting periods, trade service fees, and exclusions are defined in the enrollment application, schedule of coverage, and service contract issued at the time of purchase. In the event of a conflict between marketing materials on the Site and your signed contract, the contract controls.
2. Eligibility and Enrollment
To enroll, you must be the owner or authorized representative of a qualifying residential property. You agree to provide accurate information regarding property type, square footage, age of systems, and known pre-existing conditions. Failure to disclose material facts may result in claim denial or cancellation.
Coverage typically begins after any stated waiting period and payment of the initial contract fee. We reserve the right to decline enrollment or offer modified terms based on property inspection results, claims history, or underwriting guidelines.
3. Covered Items and Exclusions
Covered items may include HVAC equipment, plumbing, electrical systems, and household appliances as listed on your Plan. Common exclusions include, but are not limited to:
- Pre-existing conditions known at enrollment
- Cosmetic damage, rust, corrosion, or lack of maintenance
- Commercial use, improper installation, or code violations
- Secondary or vacation homes unless expressly endorsed
- Items still under manufacturer warranty unless waived
- Consequential damage such as food spoilage, lodging, or lost wages
Optional riders may expand coverage for pools, well pumps, septic systems, or roof leaks. Each rider is subject to its own terms and additional premium.
4. Claims Procedure
When a covered item malfunctions, you must notify us before authorizing repairs. Unauthorized repairs may not be reimbursed. We will assign an independent service contractor to diagnose the issue. You are responsible for paying the trade service fee stated in your contract for each approved service visit.
If a repair is not commercially reasonable, we may offer replacement with a unit of like kind and quality, up to policy limits. We may use new, refurbished, or rebuilt parts at our discretion. You must provide reasonable access to the property for inspections and repairs.
5. Fees, Billing, and Renewal
Plan premiums may be billed monthly or annually as selected at enrollment. Late payments may suspend coverage until accounts are current. Renewal offers are issued prior to expiration and may reflect updated pricing, service fees, or coverage terms. Continued payment after renewal constitutes acceptance of updated terms unless you cancel in writing before the renewal date.
6. Cancellation
You may cancel within any applicable statutory cancellation window by written notice. After that period, cancellation may be effective at the end of the current billing cycle with partial refunds calculated per your contract. We may cancel for non-payment, fraud, misrepresentation, or repeated abusive conduct toward contractors or staff.
7. Limitation of Liability
Our maximum liability for any single claim or series of related claims is limited to the applicable coverage cap in your contract. We are not liable for indirect, incidental, or consequential damages arising from equipment failure or service delays. Service contractors are independent entities; we do not warrant their workmanship beyond applicable law.
8. Website Use
Site content is provided for general information. We may modify features, pricing displays, or availability without notice. You agree not to misuse the Site, attempt unauthorized access, scrape data, or transmit malware. Intellectual property on the Site remains our property or that of our licensors.
9. Dispute Resolution
